It appears Durham LA did respond and that they may, or may not, have kept a copy. See below.
FREEDOM OF INFORMATION ACT – REQUEST FOR INFORMATION
Your request for information on Details of DCC response to Elective Home Education consultation, received on 25-FEB-2008, has been considered.
Please find below the requested information.
Draft guidelines for Local Authorities relating to Elective Home Education had been shared prior to the consultation in July 2007. Durham County Council therefore already had in place appropriate strategies for monitoring home education arrangements in line with the Home Education Guidelines.
The Local Authority’s response to the consultation was in the form of an online check sheet. The only opportunity for comment was under Additional Comments, and Durham County Council’s comment was that there needed to be a greater emphasis on safeguarding for pupils.
You may also be interested in the Council’s webpage for Home Education. It is currently under reconstruction but it is expected to be online by 14 March 2008. The page has had input from dedicated home educators.

AHEd has responded:
(We) aware of the format of the DCSF consultation and the possibility for comment via an online form. We are asking for the copy of your response rather than a paraphrased report of what you said on the consultation response form.
We look forward to you being able to supply a copy of your response to the consultation.
Durham have failed to satisfy this freedom of information request, however:
Durham's Response:
DCSF have sent files of all the responses under the category "LA" but we cannot see one from Durham. However, given that they have told us they did respond but did not want to give us a complete account of their response, it is possible that Durham could be one of the anonymous responses. There are two of these in the files from LAs that you can see from the LA responses (pdf files list) page. Scroll down to:
response 1 pages 1 -5 anonymous ... pdf One
response 69 pages 25-30 Anonymous (response of an organisation) ... pdf Eleven
